DEFINITIONS
For the purposes of this Privacy Policy:
Account: means a unique account created for you to access our Service or parts of our Service.
Affiliate: means an entity that controls, is controlled by or is under common control with a party, where "control" means ownership of 50% or more of the shares, equity interest or other voting securities for the election of directors or other management authority.
Application: means the software program provided by the Company downloaded by you on any electronic device, called PROSFY.
Company: (referred to as "Prosfy", "the Company", "We", "Us" or "Our" in this Agreement): refers to DATIFY PROFESSIONALS SLU.
Country: refers to Spain.
Data Controller: for the purposes of the GDPR (General Data Protection Regulation), refers to the Company as the legal entity that alone or jointly with others determines the purposes and means of the processing of personal data.
Device: means any device that can access the Service, such as a computer, a mobile phone or a digital tablet.
Personal Data: is any information that relates to an identified or identifiable individual.
Usage Data: refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
You: means the individual accessing or using the Service, or the company or other legal entity on behalf of which such individual accesses or uses the Service, as applicable.
Under the GDPR, you may be referred to as the data subject or user, as you are the person using the service.
2. Data We Collect
DATA YOU PROVIDE
Registration: To create an account, you must provide data including your name, email address and/or mobile phone number and a password. If you register for a Premium Service, you will need to provide payment (e.g., credit card) and billing information.
Profile: You have choices about the information on your profile, such as your education, work experience, skills, photo and city. You do not have to provide additional information on your profile; however, profile information helps you get more from our Services.
Posting and uploading: We collect personal data from you when you provide or upload it to our Services, such as when you fill in a form, respond to a survey, submit a resume or complete a job application.
DATA FROM OTHER SOURCES
Reviews: You and others may upload content that includes information about you to our Services. We may also collect public information about you, such as news and professionally relevant achievements.
Contact: We may receive your email when others invite you as an administrator or team member with our Services.
SERVICE USAGE
We log your visits and use of our Services, including mobile apps. We use logins, cookies, device information and IP addresses to identify and log your use.
COOKIES AND SIMILAR TECHNOLOGIES
We collect data through cookies and similar technologies, as described in more detail in our Cookie Policy.
DEVICE AND LOCATION
When you visit or leave our Services, we receive the URL of the site you came from and are going to and the time of your visit. We also get information about your network and device, such as IP address, proxy server, operating system, web browser and plugins, device identifier and features, cookie ID and/or ISP, or your mobile carrier.
INFORMATION PROVIDED BY YOUR EMPLOYER OR EDUCATIONAL INSTITUTION
When your organization purchases a Premium Service for you to use, they provide us with data about you.
OTHER SITES
We obtain data when you visit sites that include our ads, cookies or some of our plugins or when you log into other services with your Prosfy account.
OTHER
We are improving our Services, which means we obtain new data and create new ways to use it. Our Services are dynamic and we often introduce new features, which may require collecting new information. If we collect materially different personal data or materially change how we collect, use or share your data, we will notify you and may also modify this Privacy Policy.
3. How We Use Your Data
We use your data to provide, support, personalize and develop our Services. How we use your personal data will depend on which Services you use, how you use those Services and the choices you make in your settings. We use the data we have about you to provide and personalize our Services, including with the help of automated systems and inferences we make, so that our Services can be more relevant and useful to you and others.
SERVICES
PROSFY uses automated systems to generate inferences, salary comparisons and market analyses from available data. Our Services allow you to estimate your salary value, explore careers, evaluate educational opportunities and search for professional opportunities. We may use automated systems to provide analyses and recommendations to help make our Services more relevant to our Members, Visitors and customers. Keeping your profile accurate and up to date can help you and others have a better quality of analysis.
COMMUNICATIONS
We contact you and enable communications between members. We will communicate with you through email, mobile phone, notices posted on our websites or apps and other means through our Services, including text messages and push notifications. We will send you messages about the availability of our Services, security or other service-related matters. We also send messages about how to use our Services, network updates, reminders, job suggestions and promotional messages from us and our partners. You may change your communication preferences at any time. Please note that you cannot opt out of receiving our service messages, including legal and security notices.
SERVICE DEVELOPMENT AND RESEARCH
We develop our Services and conduct research. Such research may result in reports, studies and market analyses published or shared only in aggregate format.
Service development: We use data, including public feedback, to conduct research and development of our Services in order to provide you and others with a better, more intuitive and personalized experience, drive membership growth and engagement in our Services.
Other research: We seek to create economic opportunities for members of the global workforce and help them be more productive and successful. We use available personal data to research social, economic and labor trends. In some cases, we work with trusted third parties to conduct this research, under controls designed to protect your privacy. We publish or allow others to publish economic information, presented as aggregated data rather than personal data.
DATA THAT DOES NOT IDENTIFY YOU
We use your data to produce and share information that does not identify you. For example, we may use your data to generate statistics about our members, their profession or industry, or to publish visitor demographics for a Service. PROSFY may transform personal data into aggregated and/or anonymized information that does not allow individual persons to be identified. Such data may be used for statistical analysis, market research, preparation of salary reports, labor trend studies and improvement of our Services. Salary and market data are processed primarily in aggregate format and are not linked to individual identities. This aggregated information is not considered personal data under the GDPR.
SECURITY AND RESEARCH
We use data for security, fraud prevention and investigations. We use your data for security purposes or to prevent or investigate potential fraud or other violations of our User Agreement and/or attempts to harm our members, visitors or others.
4. How We Share Information
OUR SERVICES
The information you provide will be processed in accordance with your settings and the nature of the contracted Service. PROSFY does not operate as a social network and does not establish hierarchical structures between users.
RELATED SERVICES
We share your data across our different Services and Prosfy affiliate entities. We will share your personal data with our affiliates to provide and develop our Services. We may combine information internally across the different Services covered by this Privacy Policy to help make our Services more relevant and useful to you and others.
SERVICE PROVIDERS
We may use others to help us with our Services. We use others to help us provide our Services (e.g., maintenance, analytics, auditing, payments, fraud detection, marketing and development). They will have access to your information as reasonably necessary to perform these tasks on our behalf and are required not to disclose or use it for other purposes.
LEGAL DISCLOSURES
We may need to share your data when we believe it is required by law or to help protect the rights and safety of you, us or others. We may need to disclose information about you when required by law, a subpoena or other legal process, or if we believe in good faith that disclosure is reasonably necessary to: (1) investigate, prevent or take action regarding suspected or actual illegal activities or to assist government law enforcement agencies; (2) enforce our agreements with you; (3) investigate and defend against third-party claims or allegations; (4) protect the security or integrity of our Services; or (5) exercise or protect the rights and safety of Prosfy, our Members, staff or others. We attempt to notify Members about legal demands for their personal data when appropriate, unless prohibited by law or a court order.
CHANGE OF CONTROL OR SALE
We may share your data when our business is sold to others, but it must continue to be used in accordance with this Privacy Policy. We may also share your personal data as part of a sale, merger or change of control, or in preparation for any of these events. Any other entity that buys us or part of our business will have the right to continue using your data only in the manner set out in this Privacy Policy, unless you agree otherwise.
5. Your Choises and Obligations
DATA RETENTION
We retain most of your personal data while your account is open. We generally retain your personal data for as long as you keep your account open or as needed to provide you with the Services. This includes data that you or others provided to us and data generated or inferred from your use of our Services. Even if you only use our Services when looking for a new job every few years, we will retain your information and keep your profile open, unless you close your account. In some cases, we choose to retain certain information in depersonalized or aggregated form.
RIGHT TO ACCESS AND DATA PORTABILITY
You may access or delete your personal data. We offer settings to control and manage the personal data we hold about you. For the personal data we hold about you, you may:
Delete data: you may ask us to erase or delete all or some of your personal data (e.g., if it is no longer necessary to provide you with Services).
Change or correct data: you may edit some of your personal data through your account. You may also ask us to change, update or correct your data in certain cases, especially if it is inaccurate.
Object to, limit or restrict use of data: you may ask us to stop using all or some of your personal data or to limit our use of it.

ACCOUNT CLOSURE
If you choose to close your Prosfy account, your personal data will generally cease to be visible to others on our Services within 24 hours. We generally delete closed account information within 30 days of account closure, except as noted below. We retain your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations, resolve disputes, maintain security, prevent fraud and abuse, enforce our User Agreement or comply with your request to "unsubscribe" from our future messages. We will retain depersonalized information after your account has been closed. Information you have shared with others will remain visible after you close your account, and we do not control data that other Members may have copied from our Services.
6. GDPR Privac
LEGAL BASIS FOR PROCESSING PERSONAL DATA UNDER GDPR
We may process personal data under the following conditions:
Consent: you have given your consent to process personal data for one or more specific purposes.
Performance of a contract: the provision of Personal Data is necessary for the performance of an agreement with you and/or for any pre-contractual obligations thereof.

The Company undertakes to respect the confidentiality of your Personal Data and ensure that you can exercise your rights. You have the right under this Privacy Policy, and by law if you are within the EU, to:

Withdraw your consent. You have the right to withdraw your consent to the use of your personal data. If you withdraw your consent, we may not be able to provide you access to certain specific features of the Service.
EXERCISING YOUR RIGHTS AND DATA PROTECTION
You may exercise your rights of access, rectification, cancellation and objection by contacting us. Please note that we may ask you to verify your identity before responding to such requests. If you make a request, we will do our best to respond to you as soon as possible. You have the right to complain to a data protection authority about our collection and use of your personal data. 7. Other Important Information
SECURITY
The security of your personal data is important to us, but remember that no method of transmission over the Internet or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your personal data, we cannot guarantee its absolute security.
DETAILED INFORMATION ON THE TRACKING OF YOUR PERSONAL DATA
We use various third-party tools to manage our services and collect analytical data, including:
HubSpot and Brevo: Used as CRM to manage our customer relationships and marketing campaigns.
Sentry: Used for error monitoring and improving the stability of our services.
Mixpanel: Used for user behavior analytics and improving the user experience on our website.
Firebase: Used for analytics and mobile application development.
Google Analytics: Used to analyze web traffic and understand how users interact with our website.
These tools do not receive individual salary data or sensitive compensation information.
INTERNATIONAL DATA TRANSFERS
Your information, including personal data, is processed at the Company's operating offices and in any other place where the parties involved in the processing are located. This means that this information may be transferred to and maintained on computers located outside your state, province, country or other governmental jurisdiction where data protection laws may differ from those in your jurisdiction. Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer. The Company will take all reasonably necessary steps to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal data will take place to an organization or country unless there are adequate controls in place.
CHILDREN'S PRIVACY
Our Service is not directed at anyone under the age of 16. We do not knowingly collect personally identifiable information from anyone under the age of 16. If you are a parent or guardian and you are aware that your child has provided us with personal data, please contact us. If we become aware that we have collected personal data from anyone under the age of 16 without verification of parental consent, we take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
